The Royal Stag Mega Consumer Promotion Rajasthan 2019ā is being organized by Pernod Ricard India Pvt. Please read the terms and conditions of the ā Royal Stag Mega Consumer Promotion Rajasthan 2019ā before participating in it (hereinafter referred to as the āOfferā). By participating/ availing this Offer, it is deemed that the participants/ customers/ consumers (hereinafter collectively referred to as āParticipantā) and/or Winners have irrevocably and unconditionally accepted all terms & conditions contained herein, including any/all amendment, modification, etc. made thereto without demur and shall throughout remain bound to them as under:
1. Agreement to Terms and Conditionsā
By participating in this Offer, Participants fully and unconditionally agree to abide by the Terms and Conditions available on www.royalstagraj.in (āT & C Websiteā). Organizerās decision shall be final and binding in all matters related to the Offer is subject to all requirements set forth herein.
Organizer reserves the right to exclude any person from the Offer on grounds of misconduct or criminal record.
Organizer reserves the right to terminate, modify or extend the Offer, at any time at its absolute discretion, without assigning any reason.
2. Eligibility-
This Offer is open only for Indian citizens above 18 years of age in the select cities of Rajasthan, India (āTerritoryā). Organizerās employees and their family members, and its sponsors/partners are not eligible to participate in the Offer.
The Participant shall only be entitled to participate in the Offer, through his/her mobile number. Participation is capped at 2 in a day maximum from a particular mobile number and 10 during entire promotion duration.
3. Term of the Offer-
The Offer is open only between 3rd December 2019 to 20th January 2020, both days included (hereinafter āOffer Periodā). Thereafter, Organizer will not be obligated in any manner whatsoever. Entries beyond the Term will not be considered valid for participation in the Offer.
4. How to Participate-
Participants can take part in the said Offer via two routes as enumerated hereunder.
On-premise
This Offer is open for Indian citizens across select participating retail outlets in the Territory (hereinafter together referred to as āOn-Premise Outletsā).
- To participate in the Offer, Participants will be required to purchase minimum three (3) serves of Royal Stag Whisky, during the Term of the Offer.
Once the above criteria are fulfilled, Participants will be handed over a scratch card with a unique code mentioned therein.
Participant will then be required to SMS the unique code (ROYAL STAG < Space >Unique Code) on +918080809063 which will also be communicated through POSM.
After recording the unique code, Participant(s) will receive a SMS confirming their participation and the Participantās entry will be entered in for the lucky draw.
Off-premise
This Offer is open for Indian citizens across select participating retail outlets in the Territory (hereinafter together referred to as āOff-Premise Outletsā).
To participate in the Offer, Participant will be required to SMS a unique code (ROYAL STAG < Space > Unique Code) on +91-8080809063 which will also be communicated through POSM. The unique code could be found on the back of the flap of the mono-carton of 750 ml bottle of Royal Stag Whisky. Once the Participant has sent the unique code, his/her entry shall be recorded in the system for participating in the Offer.
After recording the unique code, Participant(s) will receive a SMS confirming their participation and the Participantās entry will be entered in for the lucky draw.
The Organizer shall not be responsible for (including but not limited to):
For any network issues due to Operator or due to any congestion in the location
For any SPAM generated messages
For any call failures
Any lost, late or misdirected computer transmission or network, electronic failures or any kind of any failure to receive entries owing to transmission failures or due to any technical reason
If the Participant has registered himself to the DND of the telecom provider/ the Participant has registered with National Do Not Call Registry/ Participant has specifically requested for not receiving messages for the specific campaign
Other conditions beyond its reasonable control.
The decision on number/s winners is subject to the Organizerās discretion.
Participant(s) may participate upto a maximum of ten (10) times during the Offer Period by sending different unique codes (subject to 2 codes per day).
5. Prizes-
Digital Vouchers: During the Offer Period, Participants after sending the correct unique code will win Paytm cashback worth Rs. 10/30/50/500/- (at random), provided the Participant has participated using the mobile number linked to their respective Paytm account(s). Only those Participants having an existing Paytm account shall be eligible for such cashback. No claim whatsoever shall lie against the Organizer in case a particular Participant does not receive the cashback due to any operational issues related to his/her Paytm account. e-wallet vouchers. The cashback shall be communicated to the Winners by the Organizer in the form of a SMS voucher (where applicable) which can be redeemed on the Merchantās app or website.
Other Physical Prizes: During the Offer Period, a total of 378 lucky Winners will be eligible to win prizes comprising of power banks (54), Bluetooth speakers (300), bike jackets (8) and helmets (8), Gloves (8 Pair). The said prizes shall be announced during the Offer Period and all lucky Winners shall be informed on their respective mobile numbers about their being the winners of corresponding prizes and the prizes shall be then collected by the winners as per the instructions of the Organizers. These Prizes shall be distributed as per the availability of each item as mentioned above, and Winners shall not be entitled to seek any replacement / exchange against the prizes that they receive.
Mega Prize: At the end of the Offer Period, a total of 8 lucky Winners from the entire pool of participants (except for the Participants already declared as winners for Other Physical Prizes) will be chosen by the Organizers by way of a lucky draw who shall be entitled to the Mega Prize comprising of a Royal Enfield Bike. The lucky draw shall be conducted within 30 days from the end of the Offer Period in the presence of an independent auditor. The Mega Prize would include the ex-showroom price of the bike and 30% gift tax. Any additional expenses (e.g. those related to insurance, RTO etc.) shall be borne by the Winners and the Organizers shall not be liable for the same. The names of the Winners shall be announced within 60 days from the end of Offer Period from the record of the Participants and by a process of random selection.
6. Intellectual Property-
All rights, title and interest, including but not limited to the Intellectual Property Rights, in the Offer material(s) and in any and all responses received shall vest solely and exclusively with Pernod at all times. Pernod or any person or entity permitted by Pernod in this regard shall be entitled to use the responses received or any information in connection with the entry in any media for future Offer, marketing, publicity and any other purpose, without any permission and or payment to the Participant.
All material submitted in connection with the Offer (whether written, audio, electronic or visual form, or a combination of those) or any photographs, video and/or film footage and/or audio recording taken of Participants are assigned to Pernod upon submission and become the property of Pernod exclusively. Pernod may use the material in any medium in any reasonable manner it sees fit. Copyright in any such material remains the sole property of Pernod.
7. General Conditions-
The Participant understands and agrees that the selected Winner(s) alone shall be entitled to prizes, subject to all terms and conditions mentioned herein, and furnishing of correct and complete details as indicated in conditions vi & vii below (including but not limited to) in the prescribed manner and to the entire satisfaction of the Organizer.
The Offer will be promoted at the sole discretion of the Organizer
Organizer will announce the selected Winner/s as per the terms set out in Clause 4 and 5 above. The Winners will be intimated on the registered mobile number from which the Participant had participated in the Offer. The decision of the management of Organizer in this regard shall be final & binding upon the Participant and/or the Winner(s), and the Participant/ Winner(s) hereby agree that no claims, disputes, etc. of any sort shall be raised against the Organizer.
Three attempts will be made to contact the Winner for claiming the Prize on the registered mobile number provided by the Winner to, and available with the Organizer. Thereafter, the Organizer, at its discretion, will choose the next winner without any further attempt to approach or contact the earlier selected winner.
The prize can neither be exchanged nor redeemed for cash/ any non-monetary consideration nor it is transferable
The Winner/ Participant (as the case may be) will be required to collect their prize after completion of all formalities (submission of signed copy of Photo ID, Age Proof, Address proof and PAN Card) to the entire satisfaction of the Organizer within 15 days. In case the Winner(s)/ Participant requests for his / her prize to be sent to them through courier, the Organizers may agree to the same subject to the Winner(s) taking complete responsibility of such a request and no complaints regarding delays or non-delivery of the prize shall be entertained by the Organizers. The Organizers though will share the details of the courier sent by them with the Winner(s). In the event, the Winner(s) does not collect their prize within the stipulated time period stated hereinabove save and except if the prize has been requested to be sent through Courier, then the validity of the prize shall lapse automatically without any further notice to the Winner(s)/ Participant in this regard.
The prize is subject to the applicable laws of India. The prize would be delivered/ handed over to the Winner only upon proper identification and verification of the Participant to the full satisfaction of the Organizer. All Winners shall be duly required to provide a copy of their PAN card and satisfactory identity proofs as may be required for the purposes of handing over the bike. Winners of the Mega Prize winner will be additionally required to provide requisite documents for the registration of the bike.
While accepting the prize under the Offer, the Winner(s) may be required to execute an āindemnity and release of claimsā form as may be provided by Organizer, as the case may be, which shall release the Organizer of all liability, loss, damage, demand, claim, etc. in connection with the Offer and prizes contemplated under this Offer. Failure to complete and sign any documents requested by Organizer may result in disqualification of such Participant and/or Winner. Thereafter, the Organizer, at its discretion, will be entitled to choose the next winner. All decisions of Organizer shall be final in this regard.

Further, it shall not be liable for any consequential losses/ damages to any Participant and/or Winners in this regard. Nothing contained herein amounts to a commitment or representation by the Organizer to conduct further likewise Offer or schemes.
Under no circumstance the Organizer, its management, directors, employees, officers, affiliates or subsidiaries, agents, representatives, etc. shall be liable to the Participant, Winners and/or any third party for any loss of profits or lost opportunity, or for any indirect, special, consequential, incidental, or punitive damages whatsoever, even if Organizer has been advised of the possibility of any such damages. The Participant/ Winners specifically agree not to file and/or initiate in person or through any family member or through any third party, any criminal and/or civil proceedings/ complaints/ applications in any courts or forum in India against Organizer, its management, directors, employees, officers, affiliates or subsidiaries, agents, representatives, etc. to claim any damages for any losses or seek relief in connection with the Offer and/or the prizes. The Participant/ Winners specifically agree that Organizer, its affiliates, its group companies, their employees, officers, directors or any other person and/or sponsors shall not be responsible for any claims/ liabilities/ losses (including legal fees) arising out of and in relation to any injury/ damage/ harm/ loss/ death/ mental or emotional trauma suffered by the Participant or prize Winners in any manner whatsoever in connection with the Offer and/or the prizes.
Organizer shall not be liable to perform any of its obligations under the Offer or in respect of the prize where it is unable to do so as a result of unforeseen circumstances, Force Majeure conditions or circumstances beyond its reasonable control.
Organizer is empowered to take a decision in case of any conditions, circumstances and scenarios beyond these terms and conditions of the Offer.
The Offer and the terms and conditions herein shall be governed by and construed in accordance with the applicable laws in India. All matters with respect to the Offer and/or prizes are subject to the exclusive jurisdiction of the courts at Delhi only. The Offer shall be deemed void where prohibited by law.
Organizerās liability at any point in time shall not exceed the value of the Prize
Any e-wallet voucher sent by the Organizer via SMS to the winners must not be further shared or reproduced by anyone other than the winner itself. In case any winner misuses or shares his/her gift voucher with any third party, the Organizer is not liable for any misuse of the same thereof and no claim shall lie against the Organizer.
