6. Winner Announcement-

1. The Prize shall be forfeited and the Winner agrees to surrender the Prize if the winner is not reachable / contactable on phone within 7 Working/Business days of Winner announcement.
2. All decisions by “Quiz by Gamepind”   regarding the selection of Winner(s) shall be final and binding.

7. Prize-

1. The Prize under this Campaign is neither assignable nor transferable under any circumstance, unless specifically provided hereunder.
2. The Prize to Winner shall be given subject to compliance with all applicable statutory legislations including RBI guidelines in respect of prepaid payment instrument, processes and formalities (including KYC formalities as may be applicable) in connection with the Prize and on production of all such documents/papers as may be applicable and required by “Quiz by Gamepind”  .
3. Any failure on Participant’s/Winner’s part to comply with directions issued by “Quiz by Gamepind”   for claiming the Prize shall entitle “Quiz by Gamepind” to forfeit the Prize.
4. “Quiz by Gamepind” shall not be responsible for any delay on part of any third party including the courier agency, in delivering the Prize (if applicable). All costs and expenses for collecting the Prize, unless otherwise specified, shall be borne solely by the Winner(s) under this Campaign. The Prize shall not be transferable and no request shall be entertained by “Quiz by Gamepind”   for such transfer.
5. 6. 8. Any Prizes to a person/Participant of value in excess of INR 10,000/- (INR Ten Thousand Only), will be subject to deduction of taxes as applicable. “Quiz by Gamepind”   shall in advance deduct TDS as per applicable Income tax rules. In case the prize is delivered/ given to the Winner, then the Winner shall pay TDS by Demand Draft (DD) equal to the TDS amount in advance in favor of Acumen Game Entertainment Private Ltd (“Quiz by Gamepind”  ”). In the event the Participant is not able to pay the TDS amount, Paytm will have the right to forfeit the Prize amount with no further liability in this regard.
9. All Prizes must be claimed by the Winner(s), and the documents (if applicable) specified below shared within 48 hours. The documents required to be submitted along with the claim by the Winner(s) include the following (the document list* is only inclusive and not exhaustive and can change as per the requirements of law):

1. Address proof (Voter ID/Driving License/Passport/electricity bill not older than 3 months/Telephone bill not older than 3 months etc.)

If the Winner fails to comply with the herein set requirements his right to win the prize shall be forfeited. 1. Post completing documentation process, the Winner will be informed (through tele-calling/Email/SMS) regarding the modalities of the prize and distribution thereof. Delivery of prize will be subject to the Winner(s) giving the correct address and his/her availability on provided address. In the event the prize cannot be delivered, when specified that it will be delivered, due to reasons beyond the control of “Quiz by Gamepind”, the Winners shall collect them from the nearest place specified by “Quiz by Gamepind”.
2. In case of anomalies in the details of the Participant registered with Paytm and documents submitted by the Participant/s claiming Prize, such Participants will stand disqualified with immediate effect.

9. Queries-

1. If Participant(s) requests for refund of his/her amount spent under this Campaign for any justified cause, “Quiz by Gamepind” will consider such request and may in its sole discretion, decide to process refund. Such refund may take up to 15 business days from the date of request for the refund has been approved by “Quiz by Gamepind”. Participant(s) acknowledges on making the request for refund the Participant(s) shall lose all the scopes for qualifying to win any Prize under this Campaign.
2. If Participants have any query or issue, they can go to the Paytm App, click on the top left options tab. Once the tab expands, click on 24×7 Help. Participants then can scroll through the ‘ I need help with’ section, select Gamepind & then register their issue accordingly.  Further, any information that the Participant may request in connection with the Campaign, may be provided by “Quiz by Gamepind” to the Participant, at the sole and absolute discretion of “Quiz by Gamepind”, depending on the nature of the information requested, and any such information may be provided as per the Clause 18 of Part-A . No such request shall be entertained thereafter. “Quiz by Gamepind”   further clarifies that any information requested by any Participant shall only concern that Participant and under no circumstances will “Quiz by Gamepind” provide confidential information or information pertaining to other Participant(s).
3. We will entertain queries maximum for the period of one month, from the time the Campaign Period ends on completion of one month period, we will not be held accountable/answerable for the queries raised by the Participants.
4. The Organiser does not make any commitment, express or implied to respond to any feedback, suggestion and/or queries of the Participants.

10. Unconditional Approval/Acceptance-

1. By participating in the Campaign, You indicate your acknowledgement and acceptance of these T&C.
2. By entering the Campaign, You confirm and waive the applicability of rules and regulations of the National Do Not Call Registry and You agree to receive promotional messages and alerts including without limitation daily updates on the score under this Campaign from “Quiz by Gamepind”, as they may in their sole and absolute discretion decide.
3. The Participant is aware that answers submitted on the WAP portal and sent by the Participant may not be received by “Quiz by GamePind” instantly due to various factors outside the control of “Quiz by GamePind”   such as Network failure, system failure etc.
4. The time at which the Participant answered through click on WAP portal from his/her handset will not be considered even if it is earlier. (Example – Participant sent answer at 14:00 hrs. but it was received by “Quiz by GamePind” only at 15:00 hrs. “Quiz by GamePind”   will consider the time as 15:00 hrs only).
5. The Participant undertakes not to dispute/challenge the delay caused in receiving the answer through WAP by “Quiz by GamePind”   due to network failure, system failure, etc., which are beyond the control of “Quiz by GamePind”.

11. Eligibility-

1. The participation in the Campaign is open only for the Campaign Period for the Indian citizens of 18 years and above of age.
2. Further, to participate in Campaign the Participant needs to have registered Paytm account.
3. The residents of any state within territory of India, wherever prohibited by Law shall not be entitled to participate in this Campaign as applicable.  
4. The residents (permanent/temporary) of any state/union territory within the territory of India shall not be entitled to participate in this Campaign, where such campaigns are prohibited by applicable law.
5. The winner (“Winner”) must have a valid Paytm KYC verified account and wallet. If the Paytm account or wallet is not KYC verified, Paytm shall not transfer the winning amount or any other gratification in the account or wallet of the Winner. Further Winner shall cease its right to claim any amount from Paytm in the absence of a verified KYC account and Wallet in future.  , The list of the Winner(s) of the Prize will be published on winners tab.
6. He/she must be registered Paytm User of the mobile number through which he/she attempted to play the Campaign and was chosen as the Winner(s) under this Campaign. The Participant must have Paytm account on his/her own name through which he/she is buying packs/questions. Also, if the Paytm registered number of the Participant is under a different name than the documents submitted on winning, s/he as a winner will be disqualified.

Part-B: Legal Terms & Conditions

1. The participation in the Offer is open only for the Offer Period for the Indian citizens of 18 years and above of age. Employees of Acumen Game Entertainment Private Limited (hereinafter referred to as “Acumen”) (including their family members & relatives)  shall not be eligible for any of the Prize under this Offer. In case it comes to the knowledge of Acumen that any Winner is an employee of Acumen or their family member or relative, Acumen reserves the right to forfeit the Prize. Further, to participate in Offer the Participant needs to have registered account on Paytm Platform.
2. The Participants who are residents (permanent/temporary) of any state/union territory within the territory of India shall not be entitled to participate in this Offer, wherever such Offer is prohibited by applicable law.
3. By participating in the Offer, Participants consent to the following information available on Paytm platform such as name, score, etc. to be communicated to its vendor as required for publication in any media for the purpose of Winner’s announcement. Acumen may, at its discretion, choose not to disclose the identity of the selected Winner(s) to other Participants unless expressly mentioned herein. The Participants also consent to the information being stored in the servers of Acumen or its service providers.
4. Participants acknowledge and agree that all copyright and trademarks and all other intellectual property rights in the SMS content, WAP, Mobile application, Website and all material or content related to the Offer shall remain, at all times, owned by Acumen and/or their respective owners. All material and content contained is made available for Participant’s personal and non-commercial use only. Any Participant providing any incorrect information or concealing/withholding any information from Acumen with intent to participate and/or be chosen as the Winner(s) of the Offer will automatically be disqualified from participating in it and being chosen as the Winner(s) of the different categories of Prize. Such act of providing incorrect information or concealing/withholding any information, including without limitation incorrect declaration of information relating to name, age, identity, address, mobile connection of Operator number, domicile etc., by the Participant or dispute with the Paytm Platform, shall entitle Acumen to disqualify him/her without any further intimation. Acumen reserves its right to take appropriate legal action against any Participant involved in illegal/unauthorized activity.

The Participants shall indemnify and keep indemnified Acumen and their officers, directors, employees, customers, and affiliates harmless from and against any and all claims, losses, suits, proceedings, action, liabilities, damages, expenses and costs (including attorney’s fees and court costs) which Acumen may incur, pay or become responsible as sponsor/organizer/facilitator as a result of (i) breach or alleged breach of the representations or obligations by the Participants under the T&C hereunder; (ii) any failure by the Participants to comply with applicable law and (iii) any third party claim in respect of misuse of any information of a third party by the Participant. Acumen shall have the right to defend themselves, pursuant to this clause, at the cost of the Participants. Acumen Game Entertainment Private Limited or their respective affiliates shall not be responsible for any direct, indirect, incidental, special, punitive or consequential damages, including loss of profits, incurred by the Winner(s) or any third party, in connection with the Offer.
